Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your use of the AdMachines Marketing Software and the associated services ("Service"). By accessing or using the Service, you agree to comply with the terms of this Policy. If you do not agree, do not use the Service.
AdMachines provides a platform and services designed to assist businesses in managing their digital marketing campaigns. In order to maintain the integrity, reliability, and security of the Service, the following activities are prohibited:
1. Unlawful or Fraudulent Activities
Client agrees not to use the Service for any unlawful, illegal, or fraudulent activities, including but not limited to:
- Engaging in or promoting any form of illegal or criminal conduct, including but not limited to identity theft, fraud, or harassment.
- Promoting or engaging in activities that violate intellectual property rights, including unauthorized use of copyrighted materials or trademarks.
2. Infringement of Third-Party Rights
Client may not use the Service to:
- Violate any third-party intellectual property rights, including copyrights, trademarks, patents, and trade secrets.
- Post or distribute any content that infringes the rights of any third party, including pirated software, illegally obtained data, or copyrighted works without permission.
3. Misleading or Deceptive Advertising
Client agrees not to:
- Engage in any advertising, marketing, or promotional activities that are misleading, deceptive, or false.
- Use the Service to engage in clickbait, fraudulent traffic generation, or misleading claims.
- Mislead users about the origin, nature, or functionality of the Client’s business or products.
4. Spamming or Unsolicited Communications
Client agrees to:
- Not use the Service to send unsolicited bulk emails (spam), messages, or advertisements to recipients who have not consented to receive such communications.
- Comply with all applicable anti-spam laws, including the CAN-SPAM Act of 2003, and similar international regulations.
- Ensure that any email campaigns or communications comply with applicable consent, opt-out, and identification requirements.
5. Disruption of Service or Harmful Actions
Client agrees not to:
- Use the Service to interfere with, disrupt, or access in an unauthorized manner any AdMachines platform, system, or data.
- Engage in any activity that could damage, disable, overburden, or impair the functioning of AdMachines’ platforms, or interfere with others' use of the Service.
- Attempt to gain unauthorized access to any accounts, data, systems, or networks related to the Service.
6. Unapproved System Use
Client agrees not to:
- Use the Service in any manner that violates the AdMachines Marketing Software Terms of Use or any associated licenses granted by AdMachines.
- Modify, reverse-engineer, decompile, disassemble, or otherwise alter the Service or any part of it, unless specifically authorized under applicable law.
- Use the Service for any purpose other than the purpose for which it is intended, or in a way that could damage the reputation of AdMachines or its partners.
7. Harmful or Offensive Content
Client is prohibited from using the Service to create, display, or distribute content that is:
- Obscene, offensive, or harmful in nature, including hate speech, pornography, or explicit materials.
- Defamatory, abusive, or harassing towards any person, entity, or group.
- Promoting violence, discrimination, or illegal activities.
8. Data Privacy and Protection
Client agrees to:
- Comply with applicable data privacy laws, including the GDPR, CCPA, and any other relevant laws regarding data protection and privacy.
- Secure explicit consent from individuals whose data is collected, stored, or processed via the Service.
- Not engage in unauthorized data collection, scraping, or mining of personal or sensitive data from users without consent.
9. Compliance with AdMachines Policies
Client must:
- Abide by all other terms and policies associated with the Service, including the Privacy Policy, Terms of Use, and any other guidelines or operational procedures AdMachines provides.
- Ensure that all activities conducted through the Service are in compliance with AdMachines’ ethical standards, terms of service, and acceptable use guidelines.
Enforcement and Consequences
Any violation of this Acceptable Use Policy may result in immediate suspension or termination of Client's access to the Service. In cases of violations that result in damage to AdMachines or other users, AdMachines reserves the right to take legal action to recover damages.
AdMachines reserves the right to monitor Client’s use of the Service to ensure compliance with this Policy, and to remove or disable access to any content that violates this Policy.

If you believe there has been a violation of this Acceptable Use Policy, please contact AdMachines immediately at legal@admachines.com. AdMachines will investigate the matter and take appropriate action in accordance with this Policy.
